I am writing to ask you to VOTE NO on SB 248 and 249 which significantly affect Michigan’s nationally recognized Auto No-Fault Law.
Senate Bills 248 and 249 are flawed and will create great instability in the Michigan Auto No-Fault system. They will impair patient access to medical care, seriously reduce revenue to the Michigan health care industry, result in a significant loss of jobs, and completely fail to provide meaningful reeducation of auto insurance premiums for the majority of Michigan citizens.
More specifically this legislation will:
Do nothing meaningful on premium rate reduction. The bill offers a $100 per car per year rate reduction for the next two years. There is nothing to prevent insurance companies from raising rates back to where they were before the reduction. This is meaningless relief for Michigan drivers especially in light of how much money insurance companies will make off the provisions in this legislation.
Not hold insurance companies accountable. The Fraud Authority’s power is limited to offenses that violate MCL 500.4503, which does not address acts of abuse, fraud, or overreach by insurers. Accordingly, the scope of the Fraud Authority under this Bill is limited purely to supposed fraud committed by individuals against insurance companies and does not require any scrutiny of insurer conduct, regardless of how unfair or abusive that conduct may be. The Fraud Authority has no power to conduct true criminal investigations regarding actual acts of fraud.
Reduce access to medical care. Trauma centers and clinics and smaller hospitals will close as a result of unfunded essential medical and rehabilitation services.
Cost Michigan jobs. These bills will force the shuttering of medical facilities all over the state, and the firing of critically needed nurses and doctors and specialists. Michigan's doctors and nurses and other care providers will be forced to leave the state to make a living. People would lose the closest and best medical care when they need it the most, after a catastrophic auto accident.
These bills are bad for Michigan and I urge you to vote no on SB 248 and 249.
